Determining Responsibility for A Defective Product

Goldstein Heslop Steele Clapper Oswalt & Smith Dec. 10, 2021

There are many different tasks that people in Pennsylvania need to complete each day. Some of these are easier than others, but over time there have been many products developed to help make these tasks easier. These products can be very valuable, but they are only useful as long as they work properly. When they break down it can be very frustrating. In some situations when these products break down, they can be dangerous as well.

When certain products malfunction or do not have effective safety features, people can suffer severe injuries requiring significant medical care. This means that people may incur significant medical bills as a result and potentially not be able to work for a period of time. This can cause significant financial troubles for the victims in addition to the physical injuries they suffer.

The victims may be able to obtain compensation from the company responsible for the defective product though, but people need to determine what type of defect caused the injury. There are three main types of product defects.

One type is a design defect. The design is defective if it creates a more dangerous product than an average consumer would expect or the injury caused was serious enough that the company should have put in extra safety precautions against causing that type of injury.

The second type of defect is a manufacturing defect. This type of defect is a strict liability type defect and it occurs when the product design was fine, but the manufacturer of the product assembled it incorrectly. The third type of defect is a lack of adequate instructions or warnings. These occur when the design and manufacturing of the product was fine, but the company failed to warn of dangers such as hot parts or choking hazards.

There are many different products that people in Pennsylvania use each day. Some of these products have defects and can cause serious injuries. The victims of these injuries can suffer serious damages as a result, but may be able to obtain compensation depending on who is responsible for the defect. Experienced attorneys understand how important compensation can be and may be able to guide one through the process.
